AEPD Inspections by Videoconference<\/span><\/h2>\n

The AEPD<\/a><\/strong> – Spanish Data Protection Agency, may carry out inspections by videoconference, according to the fourteenth final provision<\/a> of the Draft Law on Digital Efficiency Measures for the Public Justice Service<\/strong>, approved by the Council of Ministers on April twelve, two thousand and twenty-two, article 53 bis will be added to the Organic Law on Data Protection and Guarantee of Digital Rights (LOPD-GDD<\/a><\/strong>) 3\/2018, to regulate research activities through digital systems.<\/u><\/p>\n

The new Article 53 bis of the LOPD-GDD<\/strong>, will empower the AEPD<\/a><\/strong>on the possible methods of inspection, which may be carried out through digital systems that, by means of\"\"<\/a> digital systems that, by means of videoconferencing or other similar systems, allow bidirectional and simultaneous communication of image and sound, visual, auditory and verbal interaction between the AEPD<\/strong> and the inspected party.<\/p>\n

The system used must guarantee the secure transmission and reception of the documents and information exchanged, and, where appropriate, collect the necessary evidence and the result of the actions carried out, ensuring their authorship, authenticity and integrity. The use of these systems will take place when determined by the Agency and will require the conformity of the inspected party in relation to its use and the date and time of its development. <\/p>\n

The AEPD<\/strong>, with the power to inspect and sanction, may request from the Data Controller the necessary evidence of compliance with the RGPD and the LOPD-GDD, as well as the result of the actions carried out, ensuring its authorship, authenticity and integrity.<\/p>\n
