Digital Pact for the protection of people<\/strong><\/span><\/h2>\n

The AEPD has launched in the framework of the Social Responsibility of 2019<\/a>, the\"\"<\/a> Digital Pact<\/strong> for the protection of individuals with the aim of creating a great common agreement for digital coexistence, where privacy is understood as an asset for both public and private organizations.<\/p>\n

And this… what does it mean?<\/strong><\/span><\/h3>\n

It means that, in the reality imposed in recent years, where the digital is already a priority in each and every one of our spheres of life, we must reinforce digital rights, understood as rights (ability to do or exercise) and obligations (commitments).<\/p>\n

What are the commitments of this Digital Pact?<\/strong><\/span><\/h3>\n

The Digital Pact will become a reality through three key documents:<\/p>\n

Letter of Adhesion<\/strong>: letter issued by the signatory entity in which, together with the content of the other two key documents of the Pact, they undertake to disseminate and share among their staff, users and other groups the AEPD’s Priority Channel (this channel is used to urgently eliminate sexual and violent content on the Internet).<\/p>\n

Commitment to digital responsibility: <\/strong>this document will also be signed by the organization that adheres to the pact, and will have the following commitments:<\/p>\n

— Inform users about the processing of their data and the exercise of their rights.<\/strong> <\/p>\n

— Application of the principles of fairness, lawfulness, transparency, purpose limitation, data minimization, accuracy, retention period limitation, integrity, confidentiality and proactive responsibility.<\/p>\n

— Designation of the data protection delegate, <\/strong>emphasizing his or her knowledge of the subject.<\/p>\n

— <\/strong>Apply privacy “from design” and “default”.<\/p>\n

Are there responsibilities if the Digital Pact is breached?<\/strong><\/span><\/h3>\n

The answer is yes; organizations that have adhered to the Digital Pact are obliged to comply with it, and if any of its commitments are not fulfilled, administrative liabilities will be generated for breach of the legal provisions on data protection, although civil liabilities may also arise, having to compensate individuals for material and moral damage arising from the breach of personal data protection, and finally, criminal liability when criminal offenses related to the digital environment are defined.<\/p>\n

Another type of liability may be disciplinary liability for infractions in the work environment for the company, such as those related to labor and occupational risk prevention. For employees, it derives from labor breaches, such as legal faults and penalties or those established in collective bargaining agreements. <\/p>\n

It is important to note that in data protection<\/a> matters, persons over 14 years of age can give consent on their own, without the authorization of parents or guardians, so the issue of responsibilities applies to them as well as to adults, with the restrictions of the law, mainly in the criminal area.<\/p>\n

Extra contributions of the Digital Pact<\/strong><\/span><\/h3>\n

Finally, the Digital Pact proposes as an integral part of the Letter of Adhesion the Decalogue of Good Privacy Practices for the media and its own broadcasting channels.<\/p>\n

Business Adapter\u00ae joins the Digital Pact for the Protection of People<\/strong><\/span><\/h3>\n

Business Adapter\u00ae publicly declares its commitment to the fundamental right to data protection and privacy of all persons affected by its scope of influence, as a data protection agency in Valencia<\/a>.<\/p>\n

This commitment will be applicable to its customers, employees, collaborators and third parties in general, making a responsible and ethical use of technologies. To this end, it will promote as many initiatives as possible to achieve this objective. <\/p>\n

Priority Channel<\/span><\/h3>\n

In addition, Business Adapter\u00ae publicizes the existence of the Priority Channel<\/strong><\/a> where citizens may report facts that violate the fundamental rights of any person regarding the protection of their data and privacy, without their requests having been previously answered through the channels provided by the service providers.<\/a><\/p>\n

May request the urgent removal of sexual, violent, degrading or sensitive content on the Internet, which often causes irreparable damage or damage that is difficult to remedy.<\/strong><\/p>\n
