Nowadays, having a blog is something common and many people use them to publish information that is of interest to them, in addition to taking advantage of this space to express their ideas, disagreements or anything else they consider appropriate, making use of their constitutional right to freedom of expression.

However, every right has limits. One of the limits to freedom of expression may be the protection of personal data.

If in your blog you publish images of people or videos of third parties from which you did not obtain their prior consent, or publish information that makes people identifiable, you are in breach of data protection regulations, since, for example, the image and voice are considered personal data according to Article 4.1 of the RGPD, so you may be subject to a claim before the Spanish Data Protection Agency(AEPD) and receive a penalty for processing such data without a legitimate basis.

Thus, on August 31, 2022, the Agency fined a blogger for publishing on his blog videos of a third party, with the purpose of defaming him, without his consent.

The AEPD considered that there was a processing of the image of the person, and therefore, of personal data, where the person who carried out the processing (publication) did not have any legitimate basis for it, much less the consent of the data subject, so a fine of 10,000 euros was imposed(PS/00134/2022).

As can be seen, the fine can be substantial for an individual, so we must be very careful with what we publish in general and in these spaces in particular, as they are not exempt from being reported to the authorities, not only data protection, but also judicial.
