Data Protection Training in Valencia

Regarding the obligation to conduct data protection training, there are several references to the need for training in the General Data Protection Regulation(GDPR):

Article 39. 1 b), on the functions of the data protection officer:

(b) monitor compliance with the provisions of this Regulation, with other Union or Member State data protection provisions and with the policies of the controller or processor with regard to the protection of personal data, including the allocation of responsibilities, awareness-raising and training of staff involved in processing operations, and related audits. and related audits;

Also Article 88.3 of the LOPD-GDD on “The right to digital disconnection in the workplace” establishes the obligation to train personnel:

“The employer, after hearing the workers’ representatives, shall draw up an internal policy aimed at workers, including those in managerial positions, defining the modalities for exercising the right to disconnection and training and awareness actions on a reasonable use of technological tools that avoids the risk of computer fatigue“.

Special attention deserves, as far as training is concerned, the Instructions published by the AEPD in its Guide on labor relations

Page 18, Paragraph 2, Point 6.3. c) on Duties and obligations in the access to personal data / secrecy and security:

Since there is an obligation, there is a risk of penalty in the event of non-compliance.
