Business Adapter® in its quest for continuous improvement, in order to be a benchmark in the world of data protection consulting, offers its customers the Ethical Channel for Internal Complaints.
This channel is based on Article 24 of the LOPDGDD and complies with the requirements of the with the requirements set forth in the European Directive 2019/1937, on the protection of persons reporting breaches of Union law.
The ethical whistleblowing channel will be mandatory for any private entity with 50 or more employees (article 8. 3 of the European Directive 2019/1937). It is recommended for entities that have a lower number of employees but assessing the level of risk of their activity.
It will also be mandatory for insurance intermediaries (Article 199 of RD 3/2020) and for all public entities (Article 8. 9 of the European Directive 2019/1937).
This internal Ethical Whistleblower Channel is a safe and confidential way to report malpractice and/or criminal acts that could affect any entity.
The confidentiality of the data corresponding to the persons affected by the information provided will be guaranteed, in case they have been identified, since anonymity is also possible on the basis of Article 5 and 24. 3 of the LOPDGDD, Article 5 of the RGPD and Article 16 of the European Directive 2019/1937.
Our ethical whistleblower channel was created as an indispensable component of the corporate Code of Ethics of any organization, to uncover and prevent professional malpractice or violations. All this to protect the general interests of your organization and/or the welfare of society.
Business Adapter’s whistleblowing channel will be the vehicle through which its employees, suppliers, customers and other interested parties(whistleblowers) can report any irregular conduct, breaches of its code of ethics or internal rules, illegal acts (any crime such as fraud, theft, corruption, embezzlement, etc.), alerting in advance of these circumstances and to prevent any reputational, economic, social or any other kind of damage.
Complainants must have reasonable grounds to believe, based on the information and circumstances available to them at the time of the complaint, that the facts complained of are true.
In this ethical channel of complaints, the confidentiality of the facts, of the person reporting the infringements and of the persons allegedly responsible for the infringement is guaranteed (art. 199.2 RD 3/2020), the compliance with the European and Spanish data protection regulations and the security of the information is guaranteed, since Business Adapter is certified to ISO 27001).
