What is Digital Violence?

Digital violence is the new violence of the XXI century that uses new technologies, such as social networks, email or instant messaging applications, to send content without the permission of the affected persons (image or voice) and that these will cause (intentionally or not) the loss of confidentiality or reputational damage and if that were not serious, it could be worse with cases of cyberbullying, blackmail, etc..

A violence that in recent times, has been violating without control The dignity, integrity and/or safety of the persons subjected to it, thus having a serious impact on the subjects and the lives of these persons. This type of violence can occur in the private, public or work environment.

90% of people between 16 and 75 years of age use the Internet on a regular basis and almost 70% use social networks, so the risk per volume of people is enormous.

But the most worrying thing is that according to the NGO Plan International, 6 out of 10 girls suffer cyberbullying, which they say is much greater in the networks, than in the physical relationship with their peers, friends or family.

Priority Channel is introduced

On January 28th of this year, the Spanish Data Protection Agency(AEPD) presented a campaign to alert and raise awareness of the risks of sharing and disseminating private and sensitive content that undermines the dignity, privacy and security of individuals.

The AEPD offers citizens a service for the communication of complaints related to content related to digital violence, which will have a priority of attention, all this, to act with immediacy in the removal of such content and minimize damage to those affected.

This new service, called “Priority ChannelThis new service, called Priority Channel, is intended to provide express responses to exceptionally sensitive situations.

Therefore, the AEPD, as an autonomous and competent authority for the prevention and control of digital violence, has the following procedure for action:

  1. Analysis of the complaint
  2. Adoption of precautionary measures if necessary, in order to prevent the continuation of the most serious harmful acts.
  3. Sanctioning Procedure on those responsible, once the scope and consequences of the facts on the victim of digital violence have been evaluated.

The complaint may be filed by the victim or by a third party with knowledge of the facts.

Report digital violence in the company

Taking into account the above, it is obvious that these cases also occur in the workplace and one of the many shocking and regrettable cases happened in May 2019, when Veronica worker of Iveco Group and 32 years old, committed suicide after a video with sexual content was shared among co-workers.

It should be noted that this Whistleblower Channel is mandatory for:

— Companies with more than 50 employees ( article 8. 3 of the European Directive 2019/1937)

— All public companies for all public entities ( article 8. 9 of the European Directive 2019/1937)

— For insurance intermediaries ( Article 199 of RD 3/2020) with public sector customers

Without forgetting that the Organic Law on Data Protection(LOPD GDD) in its article 24 contemplates this Whistleblower Channel as something very useful for the aforementioned tasks, although it is optional.
