Endesa sanctioned by the AEPD with 50,000 euros

On August 4, 2022, Endesa Energía S.A.U. was fined 50,000 euros by the Spanish Data Protection Agency (AEPD).

In the resolution of its sanctioning procedure PS/00292/2021, for an infringement of Article 5.1.d) of the RGPD, due to the breach of the principle of accuracy of the data in the contracting of its services, by linking the CUPS of the claimant’s home with the postal address of a third party that was incorrect, resulting in the cancellation of the claimant’s supply, without her authorization.

The AEPD highlights in this resolution the importance of the measures to be adopted by companies in relation to the accuracy and veracity of the data, not only in order to avoid identity theft, fraud in contracting and the possibility of proving the contracting of their services, but also because of the damage that this may cause to customers, as well as the duty of care and diligence to which companies are obliged.
