Do you know what a Test Disc is?

A DISC TEST is a methodology used to know and analyze the personality of a person and in some companies used for example, for the processes of selection and recruitment of workers; that is to say, it helps to know which is the best candidate.

In a selection process it is also possible to know people’s skills and how they relate to their environment.

What does a Test Disc?

It performs two types of measurements:

  • Natural measurement of our actions: how we innately act when faced with situations.
  • Measurement of our ability to adapt to new environments and/or events.

Test Disc Personalities

Through the application of this methodology, we can obtain four types of personalities, with their own characteristics:

Decision: allows us to know how the person would behave when faced with conflict resolution and how he/she has made decisions to find the solution.

Influence: Ability to communicate with the people around you.

Serenity: Identifies how the person faces changes, together with pressure situations.

Compliance: Ability to assimilate the rules and how to respect them.

Test Disc and Data Protection

The DISC TEST finds its scope of application in labor relations, mainly in the selection process of candidates, but also once they are part of a company.

It is also considered by the AEPD (in accordance with STS 7922/2000, October 31, 2000, Contentious Chamber) that the subjective impressions or evaluations made in the selection process for a job position, or in personal interviews, are personal data, which must be treated under the principles of protection established in the regulation.

Although it is not mandatory to obtain consent for the processing of candidates’ data in accordance with Article 6.1.b) RGPD, they must be informed about the retention periods, how to exercise their data protection rights in relation to the personal data collected, as well as to know the selection criteria contemplated by the company.

On the other hand, the DISC TEST would be considered as one of the psycho-technical or psychological tests, which seeks to identify the skills and abilities of the candidate or worker and this would involve the processing of special category dataTherefore, it would be necessary to apply the corresponding enhanced security measures and request the data subject’s consent to access the overall result of the psycho-technical and/or psychological tests.

Taking into account that special category data will be processed, it will be mandatory to prepare an Impact Assessment. Impact Assessment (EIPD) where the proportionality of the measure is analyzed, however, everything could change if these tests are carried out by third parties and if in such cases the company only knows the Suitable / Not suitable to occupy the job. In any case, everything will be subject to the result of the EIPD.

When applying the TEST DISC, the data protection provisions, such as the principle of minimization and purpose limitation of the data collected, must be taken into account.

If the candidate does not pass the TEST DISC test and is not hired, the company is obliged to destroy the personal data of that candidate, or return the CV if necessary; if the company retains the personal data of that candidate after the end of the selection process (e.g. leave it in a database for future applications), it must obtain the consent of the person for such future processing. The data subject shall also have the right to access the test results.
