Tips to avoid receiving advertising

We have all wondered what to do in order not to receive advertising, since we are constantly receiving e-mails, messages on our cell phones or even calls offering us some type of product or service that normally are not of interest to us, which becomes uncomfortable and annoying.

How not to receive advertising?

This list is made up of all those users who have made the decision not to receive advertising without having previously given your consent and is managed by the Spanish Association of Digital Economy.

You provide the telephone number, postal address, e-mail address or any other means where you do not wish to receive advertising, so that those companies that are going to carry out an advertising campaign must first consult this list and not send advertising to the persons registered in it, in accordance with the provisions of Article 23.4 of the Data Protection Act(LOPD-GDD).

The term for such registration to become effective shall be two months from the date of registration.

Make sure you do not check boxes to receive offers, advertisements and others

Some applications, websites or online stores offer you to check a box where you can give your consent to receive advertising. If you do not wish to do so, make sure you do not check the box to receive advertising.

We remind you that if there is a previous contractual relationship with the company that is sending the advertising, so that it obtained your data previously and lawfully, this sending of advertising will be legal, as long as you have not exercised your right of opposition of article 18 of the LOPD-GDD.

Revoke your consent to receive advertising

If you receive advertising from any company where at some point you gave your consent for the processing of your data, you can reverse that situation at any time.

If the advertising is by email, SMS or WhatsApp, at the bottom of the advertising text, you will have an option (for example: click a link) to unsubscribe from these mailings that must be mandatory, easily and free of charge.

If it is a call, perhaps the most agile thing to do is to block the number from which you are being called or ask the person calling you to stop receiving calls. It is possible that you will be put through to the Customer Service department to express your wish to stop receiving this type of communication and they will be obliged to respond to your request.

Exercise your right to object

The LOPD-GDD recognizes as one of the rights of data protection, the right of opposition, which translates into the possibility for any person to express formally and directly to the issuer of advertising, your decision not to receive advertising, having to give process to your request, within the legal period of one month, as provided in Article 12.3 and 4 of the General Data Protection Regulation(GDPR).

Uses mediation

Few people know that it is possible to stop receiving advertising through a mediation procedure, such as the one proposed by the Association for the Self-Regulation of Marketing Communication.

This system is agile and free of charge for all persons, with the purpose of finding a solution to the claim presented by the user and the company regarding data protection, within 30 days.

This mediation system can be used in relation to the operators that have formalized this dispute resolution tool: Telefónica, Movistar, Tuenti, O2, Orange, Jazztel, Simyo, Amena, Yoigo, Másmóvil, Pepephone, Happy móvil, Llamaya, Lebara, Vodafone and ONO.

If none of the above works

If even though you have done any of the above actions you continue to receive advertising, you can also choose to file a complaint with the Spanish Data Protection Agency (AEPD). To do so, this link will be useful: Sede Electrónica – Agencia Española de Protección de Datos (sedeagpd.gob.es)

In order to do so, you will need to provide all the information you have available in relation to the claim you wish to file:

Robinson List:

provide documentation proving the date on which you signed up for the list in order to calculate the two-month period from when you should not have received the advertisement.

No consent:

provide the contract or documentation that proves that from the beginning of the relationship the consent to receive advertising was not granted.

Exercise of opposition or correct box marking:

if after one month of having exercised your rights with the company, you continue to receive advertising, you must provide documentation proving that you have submitted the form of the exercise of rights with the stamp of the entity, the response of the entity, if applicable, the sending of the form of the right by mail, etc.

Sending advertising by email, WhatsApp or SMS:

you will have to provide screenshots showing that you have requested to stop receiving advertising, the company’s response if applicable, if it was by phone call: the screenshot of the call where you can see the time and day, or a copy of the SMS message where you requested to stop receiving advertising.
